Florida Child Custody & Parenting Plans

Boca Raton attorneys helping families throughout South Florida

The Law Offices of Schwartz | White concentrates exclusively on successfully resolving family law matters. Our Boca Raton lawyers have more than 50 years of experience in issues involving child custody, parenting plans, visitation and time-sharing arrangements. We use our refined negotiating skills to develop equitable agreements for our clients. However, we are prepared to aggressively battle opposing counsel in court to ensure that the children’s interests are respected.

Parenting plans

The parenting plan describes the responsibility of each parent and the visitation and timesharing schedule, which is designed to allow each parent the appropriate amount of time with their children. The parties have an opportunity to agree to a parenting plan in divorce settlement negotiations or a court can decide based on the provisions set forth in Florida Statute §61.13. Parents must abide by their parenting plan until the child reaches the age of majority — typically, either 18 years of age or upon graduation from high school — or is otherwise emancipated or another modified order is issued by the court.

Sole or shared parental responsibility

In Florida, a parent who is awarded custody is referred to as having sole parental responsibility. Sole parental responsibility gives one parent the unilateral authority to make decisions. Shared parental responsibility, which is the default in Florida, requires parents to confer on all major decisions regarding their children. A court typically orders shared parental responsibility unless evidence indicates that this arrangement may be harmful to the children.

Our family lawyers take decisive, aggressive steps to protect the rights of our clients and the best interests of their children. When both parents can cooperate and follow the same parenting styles and philosophies, a shared arrangement may be most beneficial. However, in some cases where it is in the best interests of the children, for any number of reasons, we fight vigorously for sole parental responsibility to protect the children’s best interests and our client’s rights.

Time-sharing schedule

A time-sharing plan provides the basis for the parents spending time with their children. The plan should clearly detail:

  • Weekday and weekend schedules
  • Holidays and special occasions
  • Summer schedules
  • Drop-off and pick-up times and arrangements

The Law Offices of Schwartz | White helps parents negotiate a time-sharing schedule that benefits them and their children. We understand our clients’ desire to build strong relationships with their children and zealously protect their rights to do so.
