Parenting plans

The parenting plan describes the responsibility of each parent and the visitation and timesharing schedule, which is designed to allow each parent the appropriate amount of time with their children. The parties have an opportunity to agree to a parenting plan in divorce settlement negotiations or a court can decide based on the provisions set forth in Florida Statute §61.13. Parents must abide by their parenting plan until the child reaches the age of majority — typically, either 18 years of age or upon graduation from high school — or is otherwise emancipated or another modified order is issued by the court.

Sole or shared parental responsibility

In Florida, a parent who is awarded custody is referred to as having sole parental responsibility. Sole parental responsibility gives one parent the unilateral authority to make decisions. Shared parental responsibility, which is the default in Florida, requires parents to confer on all major decisions regarding their children. A court typically orders shared parental responsibility unless evidence indicates that this arrangement may be harmful to the children.

A time-sharing plan provides the basis for the parents spending time with their children. The plan should clearly detail:

  • Weekday and weekend schedules
  • Holidays and special occasions
  • Summer schedules
  • Drop-off and pick-up times and arrangements
