Here Comes Divorce Monday

Divorce3

When you talk to a friend who has recently filed for divorce, you might be surprised that your friend’s tone of voice and body language show relief more than distress.  Most likely, your friend agonized over the decision to file for divorce and felt stuck for a long time.  Even in uncomplicated cases, divorce is a bummer; the stress and uncertainty get to you, even if you know from witnessing other people’s divorce cases that these things were coming.  Despite this, filing for divorce feels like a fresh start, even though no one feels relieved to receive a divorce petition from their spouse, especially if they believed that their spouse was still committed to trying to make their marriage work.  Therefore, it makes sense that new divorce filings spike at the beginning of the year; there is even a name for it, Divorce Monday.  There are practical reasons for choosing to file for divorce at the beginning of the new year instead of the end of the old year, but if you are sure that you want to end your marriage, then there is no wrong time to file for divorce.  To get in on the Divorce Monday action, contact a Boca Raton divorce lawyer.

Why All the Fuss About Divorce Monday?

In the lingo of family law attorneys, Divorce Monday is the first business Monday of the calendar year.  Depending on the year, it can fall anywhere from January 2 to January 8; in 2025, Divorce Monday is on January 6.  It is the day when the family courts receive the greatest number of divorce petitions and also the day when law firms receive the greatest number of requests for consultations about filing for divorce.

When people file divorce petitions on Divorce Monday, their motivations are strategic ones; the couple has known for at least a month that they were going to file for divorce.  They choose to file on Divorce Monday instead of on any other day so that they can make a clean break between tax years.  It is clear to the IRS that the couple was married for the entirety of 2024 and that, for as long as 2025 has been in progress, they have been in the process of getting a divorce.

When people contact divorce lawyers for the first time on Divorce Monday, the motivations are usually personal; even if the case is simple and the divorce lawyer acts quickly, Divorce Monday will have come and gone by the time the petition reaches the court.  Instead, the spouse who contacts a lawyer is acting on a resolution to get out of the marriage in the new year, or else the usual family drama reached a boiling point during the holidays, and the petitioning spouse still had not cooled down by the first Monday after New Year’s.
