Each state has its own requirements for divorce, even though you never have to prove that the breakdown of the marriage is your spouse’s fault and not yours. Many states require the spouses to separate, with or without moving out of the marital home, a certain length of time before one of them files for divorce. This requirement is burdensome for many couples, who do not have the financial resources for one of them to move out, even though they have long since given up on their relationship and are eager to divorce.
The good news is that, in Florida, you do not have to separate before you divorce. Some people file for divorce when they have been living in a separate house from their spouses for decades, while others file a divorce petition simply because their spouse got on their last nerve that morning.
Florida law does require, however, that at least one of the spouses live in Florida for at least six months before filing for divorce. This means that, if you and your spouse got in a fight this morning, and you stormed out and drove to Florida with the intention of staying permanently, you must wait six months before filing the divorce petition.
