The First Visit After a Divorce Filing Can Be a Firestorm of Conflict

Sometimes the breakdown of a marriage is death by a thousand cuts. It is impossible to pinpoint the moment when you knew that your relationship with your spouse was beyond repair. Was it the 98th time your spouse dismissed your feelings or the 99th time? In other cases, marriages blow apart spectacularly. The spouses argue from midnight until sunrise, then sit in the parking lot of the courthouse and talk trash on the phone to their friends until business hours begin, and as soon as the doors to the courthouse open, they walk in and file for divorce. If you had a high conflict marriage, the divorce is unlikely to be peaceful. Parents have the right to court-ordered parenting time while their divorce cases are pending; if there is evidence that one parent is preventing the other from seeing the children, the court will hastily issue a temporary parenting plan even before the parties are able to work out a more durable one during mediation. Even in a relatively amicable divorce, the first co-parenting visit can be rough. If you have recently filed for divorce, and co-parenting is shaping up to be a challenge, contact a Boca Raton child custody lawyer.
Calling the Police the First Time You Try to Exercise Your Parenting Time Is More Common Than You Think
A new baby requires couples to deal with conflicts they never expected, so it is no surprise that Tyreek Hill of the Miami Dolphins got into plenty of disagreements with his wife Keeta about their infant daughter Capri. Earlier this year, Keeta became angry about how little Tyreek helped her take care of Capri, who was then three months old, and Tyreek responded that he planned to take Capri with him when he traveled to Los Angeles for several weeks. The argument escalated, and by the next day, Keeta had filed for divorce, and Tyreek had listed the couple’s condo for sale and rented an apartment for himself.
Several days later, Keeta invited Tyreek to come to the marital home and visit Capri. When he arrived, he said he would take Capri to his apartment and return her that evening. Keeta refused and called the police. The officer told Keeta that Tyreek had the right to exercise parenting time at his own residence, but he did not let Tyreek drive off with Capri, because he did not have an infant car seat in his car. When Tyreek’s mother arrived in her car with a car seat, they both went with Capri to Tyreek’s residence for his parenting time. Police intervening in first-time co-parenting transitions is a common occurrence.
